Terms of Service for Maple Grove Learning Centre

1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the tutoring, educational, and related services provided by Maple Grove Learning Centre, located at 1234 Maple Street, Interview, ON K1A 0B1, Canada (the “Centre,” “we,” “us,” or “our”).

By enrolling in, booking, accessing, or using any of our services, including through a parent, guardian, or authorized representative, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

If the student is under the age of majority in their province or territory of residence, a parent or legal guardian must accept these Terms on the student’s behalf and is responsible for all obligations arising under them.

2. Scope of Services

Maple Grove Learning Centre provides educational support services, which may include, without limitation:

  • Elementary and middle school tutoring;
  • After-school homework support;
  • Literacy and reading development;
  • Math enrichment programs;
  • Study skills and exam preparation; and
  • Small-group learning workshops.

Services may be delivered in person, online, or in a hybrid format, depending on program availability and operational needs. We may modify the format, schedule, curriculum, staffing, or delivery method of services at our discretion, provided such changes do not materially reduce the overall nature of the service purchased.

We do not guarantee specific academic outcomes, grades, test scores, admission results, or other educational achievements. Educational progress depends on many factors, including attendance, participation, and individual effort.

3. User Obligations and Responsibilities

By using our services, you agree that you will:

  • Provide accurate, current, and complete information during registration, booking, and communication with us;
  • Ensure that the student attends sessions on time and prepared with required materials;
  • Follow all Centre policies, instructions, safety rules, and conduct expectations;
  • Respect staff, instructors, other students, and Centre property;
  • Notify us promptly of any medical, learning, behavioural, accessibility, or safety concerns relevant to service delivery;
  • Not disrupt sessions, interfere with other participants, or engage in abusive, harassing, discriminatory, or unlawful conduct;
  • Not record, photograph, or livestream sessions without our prior written consent and, where applicable, the consent of affected individuals;
  • Use any online platforms, materials, or communications only for lawful and authorized purposes.

Parents and guardians are responsible for supervising minors before and after sessions, unless we have expressly agreed in writing to provide supervision during a specific program period.

We reserve the right to suspend or terminate access to services if a student or parent/guardian fails to comply with these Terms or engages in conduct that we reasonably determine to be unsafe, disruptive, or inappropriate.

4. Payment Terms and Conditions

Fees for services, packages, workshops, assessments, materials, and any other charges will be communicated at the time of registration or booking, or otherwise as posted by Maple Grove Learning Centre.

  • Payment is due in advance unless otherwise agreed in writing.
  • We may require deposits, registration fees, or prepayment for certain programs.
  • All prices are in Canadian dollars unless stated otherwise.
  • Applicable taxes, including GST/HST where required by law, will be added to fees.
  • Late or failed payments may result in suspension of services, cancellation of bookings, and/or administrative charges permitted by law.

If a payment method is declined, reversed, charged back, or otherwise not completed, you remain responsible for the full amount owed, including any reasonable costs incurred by us in collecting payment, to the extent permitted by applicable law.

We may change our fees from time to time. Any fee changes will apply prospectively and will not affect services already paid for, unless you agree otherwise.

5. Cancellation and Refund Policy

Cancellation and refund terms may vary depending on the service type, program length, and booking arrangement. Unless a separate written policy applies, the following general rules apply:

  • Individual sessions cancelled with less than 24 hours’ notice may be charged in full.
  • Missed sessions without notice are non-refundable.
  • Program packages and workshop registrations may be non-refundable once the program has started, except where required by law.
  • If we cancel a session or program and cannot reasonably reschedule it, we will provide a refund or credit for the affected portion, at our discretion and subject to applicable law.
  • Refunds, where approved, will be issued to the original payment method where practicable.

Requests for cancellation or refund must be submitted in writing to [email protected]. We may request supporting information before processing a request.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws in Ontario or other applicable Canadian law.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Grove Learning Centre, its directors, officers, employees, contractors, instructors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, or loss of educational opportunity, arising out of or related to your use of our services.

Our total aggregate liability for any claim arising out of or relating to the services shall not exceed the amount paid by you to us for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to liability, or the minimum amount permitted by law, whichever is greater.

We do not exclude or limit liability where such exclusion or limitation is prohibited by law, including liability for gross negligence, wilful misconduct, or personal injury caused by our negligence where such limitation would be unlawful.

Educational services involve judgment, effort, and participation by students and families. We are not responsible for results affected by attendance, incomplete assignments, lack of participation, or information provided by you that is inaccurate or incomplete.

7. Intellectual Property Rights

All materials provided by Maple Grove Learning Centre, including worksheets, lesson plans, handouts, presentations, assessments, logos, branding, text, graphics, and other content, are owned by us or our licensors and are protected by applicable intellectual property laws.

  • You may use our materials only for personal, non-commercial educational use in connection with our services.
  • You may not copy, reproduce, distribute, modify, publish, sell, sublicense, or create derivative works from our materials without our prior written consent.
  • Any feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation, to the extent permitted by law.

Third-party materials used in our programs remain the property of their respective owners and may be subject to separate terms and conditions.

8. Data Protection and Privacy

We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, Ontario privacy and education-related requirements.

Personal information may include student names, parent/guardian contact details, learning needs, attendance records, payment information, and other information necessary to provide and administer our services.

We may use personal information to:

  • Register and manage student accounts and bookings;
  • Provide tutoring and educational support;
  • Communicate with parents, guardians, and authorized contacts;
  • Process payments and maintain records;
  • Improve our programs and operations;
  • Comply with legal, regulatory, and safety obligations.

We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Where we use third-party service providers, including payment processors or online learning platforms, your information may be processed by those providers subject to their own privacy practices and applicable law.

9. Force Majeure

We shall not be liable for any delay, interruption, suspension, or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, severe weather, fire, flood, epidemic, pandemic, labour disputes, power outages, internet or telecommunications failures, government orders, public health restrictions, civil unrest, war, or other emergencies.

In such circumstances, we may reschedule, modify, or temporarily suspend services without liability, subject to applicable law and any reasonable refund or credit policy we may apply.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our services, legal requirements, or operational practices. The updated Terms will be effective when posted on our website, provided to you, or otherwise communicated to you, unless a later effective date is stated.

Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using our services.

11. Applicable Law and Jurisdiction

These Terms and any dispute arising out of or relating to them, our services, or your use of our services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

Subject to any mandatory consumer protection or other non-waivable legal rights, the parties agree that the courts located in Ontario shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the services.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed or limited to the minimum extent necessary so that the remaining provisions remain in full force and effect to the fullest extent permitted by law.

No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy.

By using the services of Maple Grove Learning Centre, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
